Mediation is a voluntary process in which couples are helped to explore issues which arise on divorce or separation and to find solutions which meet the needs of their particular family. This may include considering arrangements for children, housing and financial issues. Mediation is an alternative to going to court or using lawyers to negotiate a settlement. It encourages finding a solution together and it can reduce tension and hostility, which is particularly important where there are children. It is generally a much quicker and less expensive route to settlement. The issues people need to think about include:
Separation or divorce – the future of the relationship
The practicalities of separation
How we will tell the children and help them adjust to the new situation
Who the children will live with
When they can spend time with the other parent
How much money each parent will contribute to support them
How future decisions affecting the children will be made
Housing for each of us
How the other assets will be divided
Whether either of us will be paying maintenance to the other
What will happen to pension rights
